Terms of delivery (V2.1)
Please, before you order a subscription or make use of the CrashPlan.nl trial, take notice of the terms of delivery shown below. On the order form you need to check that you agree to these conditions. For questions you can reach us at info@crashplan.nl
1. Trial
- With full and accurate completion of the "Create your Account" form, you receive a full free trial for a period of 2 weeks for the online backup service of Crashplan.nl.
- You then have access to the full backup software – without speed limits – and you make free use of our online backup storage space on the same servers where paid subscriptions also connect to.
- Are you following this trial period not convinced, then we deactivate your account and delete your data. Your trial will not automatically turn into a paid subscription. Would you continue to use the online backup service, then turn your trial into a paid subscription. In this case the backups continue running without interruption.
2. Paid subscription
- The first time we'll bill you at the time you order (which is proportional to the number of calendar months remaining from the month in which order), and then annually in January.
- Invoices you need to satisfy within 14 days after the invoice date. Exceeding this term of payment might pause the online backup service. Your backup software send a warning by default, (b), and alarm, (c) that there is no backup made any longer.
- Where payment exceeds by 30 days the agreement is unilaterally terminated and your data is deleted, see 5.3.
3. Extent of the Crashplan.nl online backup service subscription
- Crashplan.nl makes backups of the data you selected, to an agreed maximum amount of data – space quota: (c) – on its servers. Thereafter, no new backups are made, until you order additional storage space (50GB minimum).
- Crashplan.nl offers limited support by e-mail, which means that questions regarding the online backup subscription usually not directly, but answered within 24 hours usually.
Optional forms of support – including advice by chat, telephone and onsite – are granted on the basis of a debet card system. The debet card will be charged in advance. It is measured in units of time of 15 minutes. There is no money returned for unused value. - CrashPlan.nl does not make reserve copies of your backed up data on its servers, see the backup specifications.
4. Unsubscribe
- You can terminate the service at any time.
- By sending an email to info@crashplan.nl.
- Once your notice (by e-mail) arrives at us, we will send you a confirmation.
- This first confirmation you need to confirm to us.
- Upon receipt of your second confirmation, you will receive our second and last confirmation.
- Your account and back-up data is by December 31 of each calendar year removed. You will receive no new bill for the next year.
- There is no refund of prepaid fees instead.
- Subscriptions for one year amount > € 1000,- can be terminated each month. These subscriptions can claim a refund of prepaid fees, less € 44.50 administration costs.
5. Billing & payment
- The bill is by e-mail message.
- The invoice has a payment period of 14 days. When the invoice is not paid within 30 days, Crashplan.nl has the right, without judicial intervention, with immediate effect to cancel the agreement; deactivate your account and to remove your online backup data, without being or to be liable for damages.
- Invoicing for optional backup services and products are interim and will also be sent per e-mail message, and should immediately be paid. Optional services are carried out once the payment is received.
- All amounts (unless otherwise stated) are in euros, excluding taxes (VAT) and other government levies, and apply to payment condition (TT) in advance.
6. Liability
- You are solely responsible for the settings of the backup software, in particular we mention:
- the choice to how many and which destionations you sent back-ups to;
- to select the folders and files you want backed up;
- verify that your files are actually backed up; aren't they? Let uw know;
- the provision of accurate, full contact details, and immediately pass changed contact details, during the term of the agreement (so we can reach you).
- The CrashPlan.nl liability is limited to a maximum amount that you paid her.
- Crashplan.nl offers no guarantee on the backup software.
- By providing an exchange disk outside the Netherlands incoterms DDU (Delivered Duty Unpaid), ie delivered exclusive rights. The risk is transferred to the buyer once the exchange is delivered. Cost and risk of the return shipment to the supplier on behalf of the customer. Demonstrate when and by whom the return receipt is taken from the supplier, is the risk of the customer.
- Crashplan.nl can never be liable for any damages directly or indirectly caused by the incorrect interpretation and / or improper use of the Crashplan.nl information, software or other services.
7. Force majeure
- If in the exceptional case Crashplan.nl servers stop functioning, Crashplan.nl will do its utmost to make them go back to work again as soon as reasonably possible but can not commit to a specified time.
- In a very exceptional case (fire, theft, etc.) your online backup data, stored on our servers, housed in secured data centers, can be lost. To reduce this loss risk and to achieve higher availability, we recommend you to backup to multiple backup destinations.
8. Guarantee privacy – Safe and secure
- By placing an order, your (business) data included in our customer base. All information you provide will only be used for internal processing within the framework of responsible management and execution of our online backup service. We provide no data to third parties other than necessary for safeguarding our online backup service. You will not receive any unsolicited mail (spam) from us other than important communications.
- The CrashPlanPRO software encrypts your data when your data is read. Your backup files are then only accessible:
- with your personal login name and password,
- for employees of CrashPlan.nl (to assist you in disaster recovery at your request).
- Beside that you can set an extra data password (b), allowing you to increase the security significantly again. Then your information only accessible with the combination of:
- your personal login name, password and your data password.
Without your data password even CrashPlan.nl can not access your data.
- Do not worry: your data may be stored elsewhere, but your personal information will remain private.
